To promote de-criminalization under Chinese legal condition, it is necessary to make clear the background, pursuit of value, theoretical foundation and proper determination of decriminalization.

• 而欲借鉴非犯罪化,就必须清楚非犯罪化产生的社会背景、价值追求、刑法理论的根基及对非犯罪化的合理界定。本文拟就以上问题进行分析、界定,以期推动在中国法治环境下的非犯罪化。
